IMPORTANT - BEFORE USING PATIKAweb SOFTWARE, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS
LICENSE AGREEMENT. BY USING THE SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY
AND ARE BECOMING PARTY TO THIS LICENSE AGREEMENT.

This license
covers use of the PATIKAweb
software (the "Software") at your site or location and the data
stored in the PATIKA database (the “Data”). Use of the Software and the
Data is permitted provided that all of the following conditions are met:
1. LIMITATIONS
ON USE
Your use of the Software indicates that: (i) You are affiliated with an
educational or non-profit research institution and you use the Software on
behalf of that institution; OR (ii) You use the Software for education and
research on the non-commercial and non-profit basis. If use of the Software
contributes to a publication, product, or service, proper attribution must
be given; see www.patika.org/credit.html.
2.
DISTRIBUTION
You may not rent, lease, reproduce or distribute copies of the Software or
documentation to any other institution or individual. You may not modify
the Software or the documentation without the prior written consent of
Licensor. You may not reverse assemble, reverse compile or otherwise
attempt to create the source code from the Software. You shall not
misappropriate Licensor's name or any Licensor trademark or service mark.
Licensor has no control over your use of the Software, and Licensor does
not and cannot warrant the performance results that may be obtained by its
use.
3. SUPPORT AND
MAINTENANCE
You agree that (i) Licensor bears no obligations whatsoever to provide any
kind of support or to provide any kind of maintenance of the Software
licensed to you on the conditions of this license, AND that (ii) Licensor,
following its own and sole discretion, may choose to correct reported bugs
in the Software.
4. COPYRIGHT
AND BACKUPS
The Software and related documentation are copyrighted. Except as set forth
above, you may not copy the Software except to provide backup copies as set
forth above and to load the Software into the computer as part of executing
the Software.
5. OWNERSHIP
You agree that you neither own nor hereby acquire any claim or right of
ownership to the Software, documentation and the Data or to any related
patents, copyrights, trademarks or other intellectual property. This
includes any data submitted by you to be part of the Data while using the
Software. You own only the magnetic or other physical media on which the
Software and related documentation are recorded or fixed, if any. Licensor
retains ownership of the documentation, the Data and all copies thereof and
the Software recorded on the original media and all subsequent copies of
the Software at all times, regardless of the form or media in or on which
the original or other copies may subsequently exist. This license is not a
sale of the original or any subsequent copy.
6. PERMITTED
DATA USE
The uses of the Data which are permitted by Licensor, as follows:
You may make
use of the Data obtained as a result of using the Software in any way
described in Section 1 and may store the Data in electronic form, provided
that at any one time, no more than 1,000 records are stored. You are
permitted to share the Data in a reasonable, limited way with others in any
way described in Section 1; provided, however, that any such sharing may
not result in an aggregation of the electronic records stored by individual
users, nor in the creation of any central source of electronic records.
Stored data must be deleted when you no longer need them. Under no
circumstances may the Data be used for any purpose other than those
mentioned in Section 1 for the use of the Software. Any use beyond the
limited use described herein, requires the advance written permission of
Licensor.
7. TERM AND
TERMINATION
This license is effective until terminated. You may terminate this license
at any time by destroying the Software and documentation and the permitted
backup copies. This license will be subject to termination if you fail to
comply with its terms and conditions. You agree that, upon termination, you
will destroy (or permanently erase) all copies of the Software and
documentation.
8. DISCLAIMER
OF WARRANTY
THE SOFTWARE
IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. ANY EXPRESS OR
IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
ARE EXPRESSLY DISCLAIMED.
IN NO EVENT
SHALL LICENSOR, ITS AFFILIATED INSTITUTIONS OR COMPANIES BE LIABLE FOR ANY
DIRECT OR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL
DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR
SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER
CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT
LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY
OUT OF THE USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH
DAMAGE.
A PORTION OF
THE SOFTWARE CONTAINS THIRD-PARTY SOFTWARE AND NO SUCH THRID PARTY WARRANTS
THE SOFTWARE, ASSUMES ANY LIABILITY REGARDING USE OF THE SOFTWARE OR
UNDERTAKES TO FURNISH ANY SUPPORT OR INFORMATION RELATING TO THE SOFTWARE.
IN NO EVENT MAY YOU BRING ANY CLAIM, ACTION OR PROCEEDING ARISING OUT OF
THE WARRANTY SET FORTH IN THIS SECTION 8 MORE THAN ONE YEAR AFTER THE DATE
ON WHICH THE BREACH OF WARRANTY OCCURRED.
This license
will be governed by the laws of Republic
of Turkey, without
reference to its choice of law rules.
